MODULE #7-8: THE EXECUTIVE AND
JUDICIAL BRANCHES AND THE INDIAN

 

I.          Prerequisites :   Admission to the course.

II.         Estimated Time :  1 - 2 Class sessions.

III.       Goal of the Module :  This module will provide learning activities
          designed to enable the student to  identify key powers of the
          Presidency with regards to Indian affairs; to evaluate the power
          trends toward Indian affairs exerted by the Presidency and; to
          identify the framework of the Federal Indian Bureaucracy.  The
          student will be able to delineate the role of the Court system in
          Indian affairs specifically, to identify the structures and functions
          of the courts and how they relate to the protection of Indian civil
          liberties.

 IV.    Pre-assessment :  Before beginning this module, complete the
         paper and pencil test.

 V.    Objectives :  After completing this module, the student will be able to :

         A.  The student will be able to delineate the dominant role played by
               the President in Indian policy formulation.       

         B.  The student will be able to trace the history and importance of
               the Bureau of Indian Affairs.

         C.  The student will be able to delineate between treaty power and
               executive agreements.

         D.  The student will be able to list five ways in which the B.I.A.
               attempts to restrict tribal sovereignty.

         E.  The student will be able to delineate the structure of the
               Federal Court system.

         F.  The student will be able to delineate at least three different
               types of law.

         G.  The student will be able to define the scope and function of
               the U.S. Claims Court concerning Indians.

          H.  The student will be able to identify and state the political
               impact of ten landmark Indian court cases.

 VI.     Instructional alternatives :

                             and Pan-Indianism
VII.      Post - assessment : Complete the objective test at the end of
           this module.

 VIII.     Remediation :  If mastery criteria is not achieved, check with
            the instructor to obtain the necessary alternatives to master
            the objectives.
